| | Spring is on its way…I hope! I think the only good thing about such a long winter is that a lot of work has been done! Who wants to be outside in this? In my last newsletter, I updated you on the activities, to date, of the WHIMA. I would like to spend some time during this message to update everyone on what AHIMA has been up to…WOW!
I attended Virtual Team Talks on March 27, 2008. The amount of information presented was mind-boggling! When I heard all the activities our association is working on I got very excited! It is truly an amazing time to be in this profession…it is a time that we will make history-making differences.
I will organize this message with updates on the following: AHIMA Future Strategy, Update on House of Delegates (HOD) Forums, Policy Briefing, Key 2008 Initiatives, and the myPHR Campaign.

Act 108--Changes to Wisconsin Chapter 146 and Wisconsin Statute 51.30

| | Act 108 improves communication among health care providers and others who care for patients. The enactment of Act 108 is the result of the proposals by the Governor's eHealth Board, which were based on the solutions identified in the Health Information Security and Privacy Collaborative (HISPC) grant. WHIMA has representation on the Governor's eHealth Board, and had participants on the workgroups for the Board and the HISPC grant. AHIMA recognized the participation of WHIMA members with presenting WHIMA with the 2007 CSA Core Service Achievement award. It is an achievement for WHIMA to experience legislation from creation to enactment.
Wisconsin Chapter 146 changes are effective April 1, 2008.
• Elimination of the Accounting of Disclosure. Wisconsin Statutes 146.82(2)(d) and 146.82(3)(c) are repealed. Therefore, beginning April 1, 2008, health care providers will only need to account for disclosures as required under HIPAA (45 CFR 164.528)
• Redisclosure Permitted for Covered Entity. Wisconsin Statute 146.82(2)(d) is repealed and Wis. Stat. 146.82(5)(b) is created to address redisclosure. A covered entity may redisclose a patient health care record it receives under Wis. Stat. 146.82 without the consent by the patient or person authorized by the patient if the redisclosure of the record is a release permitted under Wis. Stat. 146.82. For example, if a health care provider receives a record under Wis. Stat. 146.82(2) then that receiving health care provider may redisclose the record if the record is released as permitted under Wis. Stat. 146.82.
• Non-covered Entity Redisclosure. Wisconsin Statute 146.82(5)(c) permits redisclosure if an informed consent is obtained, a court of record orders the redisclosure, or the redisclosure is limited to the purpose for which the record was initially received.
• Release of Record to Identified Persons. Wisconsin Statute 146.82(4) permits a health care provider to verbally release a portion, but not a copy, of a patient's record to any person, if the patient or person authorized by the patient is not incapacitated, is physically available, and agrees to the release of that portion of the record. If the patient is incapacitated or not physically available, or if an emergency exists and if the health care provider exercising professional judgment determines that the verbal release of the portion of the record is in the best interest of the patient, the law permits a member of the patient's immediate family, another relative of the patient, a close personal friend of the patient, or an individual identified by the patient to receive that portion of the record. The law further permits any person to receive verbally that portion of the patient's record that is necessary to identify, locate, or notify the patient's immediate family.
Wisconsin Statute 51.30(4)(b) 8g changes are effective October 1, 2008.
• Disclosure to Any Health Care Provider. Treatment facilities may release to a health care provider involved with an individual's current treatment the individual's name, address, date of birth, the name of the individual's provider for mental health and developmental disability services, the date of those services provided, the individual's medications, allergies, and diagnosis, diagnostic test results, and symptoms; and other relevant demographic information necessary for the current treatment of the individual. "Diagnostic test results" does not mean the results of psychological or neuropsychological testing.
The Department of Health and Family Services (HFS) wants to be informed if a health care provider experiences difficulties in implementing these changes. Concerns should be sent to eHealth Board Web Site
Other Legislative News:
• Administrative Code HFS 144 Immunization of Students is revised and effective. HFS 144.03(10)(a) indicates "Vaccine providers shall disclose a student's immunization information ... to a school or day care upon written or verbal request from the school or day care center. Written or verbal permission from a student or parent is not required to release this information to a school or day care center.
Act 108 and HFS 144 are available on the AHIMA Wisconsin CoP with proposed changes to HFS 124!!!!!

New Graduate Has Passion for Coding

Spotlight on Jean Burkart, RHIT
We are starting a new column in The Link called “New Graduate Focus”. This column will introduce recent HIM graduates to the WHIMA community. I would like to introduce Jean Burkart, RHIT. Jean is a May 2007 graduate from Chippewa Valley Technical College in Eau Claire, Wisconsin. She earned an Associate Degree in Health Information Technology. Jean passed her RHIT exam in October 2007.
Before Jean graduated from the HIT program, she worked in the electronics industry for 19 ½ years. Since graduating, Jean worked as a Medical Records Director for a long-term care facility for six months. She then received a position as a coding technician for a home care facility. Jean will soon earn her Home Care Specialty-Diagnosis (HCS-D) coding certification.
Jean has always had a passion for coding. The coding field is something she has wanted to do from early on in her HIT education. She enjoys the challenge of coding to the highest level of specificity and coding accurately. She enjoys the constant learning that comes along with coding, such as coding rules, regulations, etc. Jean states she will be a student trying to find understanding for her entire career.
Jean has offered some great advice for other students, graduates and professionals who may be interested in the coding field. She says to pay attention in school, ask questions and utilize the instructors, as they are the greatest resource. Complete your homework and practice, practice, practice! Lastly, Jean says to follow your dream and do not give up. Persistence does pay off and she is living proof.
Jean feels that she has found a career that she will never be bored in and she enjoys the challenges she faces every day in the coding field.

Come to the Medical Documentation and Coding Improvement Workshop on May 16 at the Marriott Milwaukee West in Waukesha, WI. The program will address CMS rules and regulations; severity diagnoses; Pathophysiology as it relates to coding, the appropriate query process and offer traing for coders, nurses, and physician liaisons. Dr. Virginia Berglund, the workshop leader, is a nationally recognized expert in inpatient physician documentation and coding compliance.

Attend the 2008 Fall Conference at the Glacier Canyon Lodge in Wisconsin Dells, Wisconsin on September 11 & 12. The Fall Conference Team led by Malinda Mielke is busy identifying topics.
WHIMA Logo Wear Team reverses global warming! While that may be a slight stretch, they are including a "going green" initiative this year by providing water bottles for $5.00 at this year's Annual Conference. These reusable water bottles will be emblazoned with WHIMA's logo and stars, in keeping with this year's theme, Magic at the Movies. As an added bonus, a random number of water bottles will have a Marcus Theater movie ticket in them, so be certain to look before filling!
Other products available at the Logo Wear booth include three different styles of backpacks / slings, baseball caps and visors, fleece vests and other clothing all sporting the WHIMA logo. All proceeds from the sale of these products go into the WHIMA Scholarship fund.
During the Business Meeting on Thursday, everyone is urged to bring or wear a Logo Wear item including from previous years. Everyone with a WHIMA logo is included in a special drawing. There is also a Movie Night Basket drawing at the Logo Wear booth.

The 2008 AHIMA Nominating Committee announced that Chrisann Lemery, RHIA from Wisconsin is a candidate for the 2009 Board of Directors for AHIMA. Help us get the message out to your fellow HIM professionals to cast their vote in the 2009 election. The polls will be open June 17 at 9 a.m. Central Time until 5 p.m. on June 30th. You will be able to cast your vote via the AHIMA web site only.
Kudos to Chrisann Lemery on your nomination and candidacy for the AHIMA Board of Directors!
In January, AHIMA launched the campaign, "It's HI Time America!" to educate and increase the public's awareness of the importance of personal health recors (PHRs). The PHR web site is a user friendly Web site that offers consumera a step-by-step guide for creating a RHR.
Cathy Hansen, Director of Health Information Services at St. Croix Regional Medical Center, and one of WHIMA's coordinators for the PRH awareness campaign in Wisconsin will present AHIMA's new initiative at the 2008 WHIMA Annual Conference.
Health Information professionals have the opportunity to audition for new roles--as agents, producers, directors and stars. From April 27 to May 3, this special week offers opportunities for all of us to thank some of WHIMA's most valuable assets — our volunteers — and to recognize the myriad of ways they improve our association.
National Volunteer Week reflects the power that volunteers have to “inspire by example” — volunteers both encourage those they help and motivate others to serve!
This year's theme is "Volunteer to Change the World". National Volunteer Week was created in 1974 when President Richard Nixon signed an executive order to establish the week as an annual celebration of volunteering. And every year since that time, each U.S. President, along with many governors, mayors and other elected officials, has signed a proclamation promoting National Volunteer Week.
WHIMA will recognize our volunteer "stars" at the Leadership Awards and Volunteer Recognition Luncheon on Wednesday, April 30th at the Osthoff Resort in Elkhart Lake. We encourage you to congratulate the members who volunteer and we invite you to join in the celebration of their accomplishments.
