Release Restrictions and Patient Amendments

Session Description:

For certain health information, patients have the right to tell us their choices about what we share, when we share it, and who we share it with. If a patient has a clear preference for how we share their personal information, they need to tell us.  And more importantly, we need to provide opportunities for patients to inform us how they want their PHI handled. “Tell us what you want us to do, and we will follow your instructions.”

We will discuss how the Cures Act, AODA, and other regulations impact how healthcare organizations and providers meet their responsibility “to maintain privacy and security” of protected health information while operating in an “open-notes” environment.  We will look at ways technology can improve, and ways technology can complicate the process of meeting the intent of our patient’s instructions.

Objectives:

  1. Tie current and emerging regulations back to HIPAA regulations using the NPP as a common theme.
  2. Remind attendees to keep their focus on the intent of the regulations as they develop policies and procedures to comply with those same regulations.

This presentation will examine the challenges and lessons learned and the ongoing hurdles including patient access and defining EHI. The session will also include compliance strategies.

This presentation will help attendees rethink how they define quality standards for both internal staff and outsourced vendors. The speaker will also provide scenario-based examples that apply Six Sigma principles (e.g., problem statement, Pareto, 5 whys, root cause analysis, and Poka Yoke) to several HIM functions, including coding, ROI, and CDI.

Learning objectives:

  1. Explain how HIM professionals can apply various Six Sigma principles to coding, the release of information, and CDI to improve quality and reduce customer abrasion.
  2. Set meaningful quality expectations for outsourced vendors and internal staff.
